Herculaneum Municipal Court

The Herculaneum Municipal Court is held on the first Wednesday of each month in the Board of Aldermen Chambers in Herculaneum City Hall,
#1 Parkwood Court.

The Herculaneum Municipal Court begins at 6:00 PM.

MESSAGE FROM THE HERCULANEUM MUNICIPAL COURT

You have been summoned to come to court on the date shown on your ticket. 

You may plead not guilty by coming to court and a trial date will be set. 

You may plead guilty by mail or by coming to the Herculaneum Court to pay your fine.

If you plead guilty, you will be given a new date to pay if you can’t pay the day of court. 

If you want to plead guilty, but you don’t have the funds to pay your ticket, you still must come to court.  You will not be arrested for not having money to pay. 

If you are indigent, you will be required to complete documentation to be determined by the court as evidence of your financial status and as an aid to the court in assessing fines, costs and setting of a payment plan.

If you do not come to court when summoned to do so, you are subject to a warrant being issued for your arrest.

If you have any questions regarding Municipal Court that cannot be answered by the information provided, you need to contact a private attorney for legal advice.  The Municipal Court staff cannot give you legal advice.

Please review the following information because it may very well determine how you decide to proceed with your case:

You Have the Following Rights

  • To understand the nature of the charge against you
  • To be aware of the minimum and mandatory penalty
  • To be represented by an attorney
  • If you cannot afford an attorney one will be appointed to you if there is the possibility of a jail sentence

If you plead not guilty you will have the right:

  • To a trial by a judge or jury
  • To present witnesses on your behalf
  • To confront and cross examine witnesses against you
  • To testify if you desire, but you cannot be compelled to testify

If there is a fine you have the right:

  • To make periodic payments in an amount you can afford
  • To present evidence of your financial condition if you cannot afford to make payments
  • To request community service as an alternative

If this is your first time appearing in court on this charge you have the right:

  • To request a continuance of your case to seek legal counsel from the Judge

You Have the Following Responsibilities

  • To appear in court and make payments when required
  • To inform the court of all address changes when a case is active
